Repealed in part

Where the repeal is restricted in its application either by a limited extent or for specified purposes the text of the Part, Chapter, Schedule or Act should be retained and an F-note inserted at the top of the Part, Chapter or Schedule, or at introductory text level for an Act. The instructions in this section should therefore only be followed if:

  • this is the first time the Part, Chapter, Schedule or Act has been repealed, and
  • the repeal is for a limited extent or for specified purposes.

Part, Chapter or Schedule

Instructions

  1. In the effects spreadsheet identify:
    1. the Part, Chapter or Schedule to be repealed;
    2. the geographical extent of that repeal; and
    3. if there are any qualifications to the "IF Date".
  2. On the "HighLevel" tab of the higher amendments "Update Details" page, scroll down the "Table of Contents" to find the Part, Chapter, Schedule or relevant Heading level to be repealed and click on it. This will take you to the familiar lower level style "Update Details" page.
  3. Click the "Check out for edit" button and set up your XMetaL workspace.
  4. In the amended provision, place the cursor after the "<ukl:Number>" at Part, Chapter or Schedule level (this is at the top of the document after the "<ukl:Part"/"<ukl:Chapter"/"<ukl:Schedule" opening tag) but before the number of the Part, Chapter or Schedule.
  5. Single click on the task to highlight it in the "Resource Manager" window.
  6. On the toolbar at the top of the page click "Legislation" --> "Non-Textual Amendments" --> "Insert Commentary"; this will
    1. generate a green tick next to the task in the "Resource Manager" window,
    2. insert the annotation of the task, and
    3. insert a "ukl:CommentaryRef" tag and unique task number after the Part, Chapter or Schedule's opening "<ukl:Number>" tag.
  7. Check the annotation has been generated.
  8. Scroll back up to the top of the Part, Chapter or Schedule to check the "ukl:CommentaryRef" tag has been inserted.
  9. On the toolbar at the top of the page click "Legislation" --> "Check In".
  10. In the pop-up "Document is checked in successfully" click "OK".
  11. Go back to the "Update Details" page:
    1. refresh the page by pressing "CTRL" and "F5" at the same time, and
    2. check the amendment edit status has changed to "Edit Complete".
  12. Select the tab "Newly Edited Version" or the "Preview Provision" button to check the annotation is:
    1. in the introduction of the Part, Chapter or Schedule and also in its child provisions when checked separately;
    2. is correct with reference to TOES:
      1. it is punctuated correctly, and
      2. the following elements are present (as applicable): Amended Provision – Type Of Effect – Extent* - Commencement Date – Amending Legislation – Amending Provision – Commencement Authority – Savings* - Commencement Order*  ?

          *if applicable

Repealed in part: applying incremental amendments

Where the Part, Chapter, Schedule or Act has previously been repealed in part but is still restricted in its application, either by extent or for specified purposes, in your current Point in Time, your task is to check the automatically generated annotation. The system will insert the new commencement information into the "F-note" of the previous repeal in part amendment. There can be several Points in Time before the amendment comes into force wholly or for whole extent, the instructions in this section should be followed for each of these amendments but only if:

  • the Part, Chapter, Schedule or Act has been repealed previously for a limited extent or specified purpose, and
  • this amendment brings that specific amendment further into force for specified purposes or limited extent (if, instead, the repeal in your Point in Time brings the amendment wholly into force and/or extends the amendment's extent to the whole extent of the Part, Chapter, Schedule or Act, follow these instructions).

Instructions

On the amendment's "Update Details" page select the tab "Newly Edited Version" or the "Preview Provision" button.

  1. Check the F-note is at heading level.
  2. Check the corresponding annotation is punctuated correctly, and with reference to TOES check the usual annotation elements are present and the following elements have been inserted:
    1. at the start of the annotation in the bracketed commencement date:
      1. the additional commencement date, and
      2. the commencement date qualification;
    2. at the end of the annotation:
      1. the commencement order,
      2. the commencement provision(s), and
      3. Savings (if applicable).

  • If any of the new elements of the annotation are missing, follow the guidance on manual auto annotations [link].

Repealed wholly

No previous retained text repeals

Where the repeal of the Part, Chapter, Schedule or Act is wholly in force and whole extent, there is an option to use the Auto Repeal function. These amendments are not carried out in XMetaL but automatically generated by the system when the Auto Repeal button has been selected from the "Update Details" page (accessed by clicking on the "Details" button next to the update task you are going to complete on the "Update Overview" page). The instructions in this section should only be followed if the repeal in your current Point in Time is:

  • the first time the Part, Chapter, Schedule or Act has been repealed,
  • for the whole extent of the Part, Chapter, Schedule or Act; and
  • wholly in force.

Instructions

  1. In the effects spreadsheet identify:

    1. AN ACT: click on the "Auto Repeal" button at the top of the "Table of Contents" on this page;
    2. A PART, CHAPTER OR SCHEDULE: scroll down the "Table of Contents" to find the Part, Chapter, Schedule or relevant Heading level to be repealed and select the "Auto Repeal" button next to the heading of that Part, Chapter or Schedule.
  3. In the pop-up click "OK", the system will automatically carry out the repeal and refresh the "Update Details" page.
  4. Select the tab "Newly Edited Version" or the "Preview Provision" button:
    1. check the amendment is formatted correctly and consistently within existing text,
    2. check the annotation is correct with reference to TOES:
      1. it is punctuated correctly, and
      2. the following elements are present (as applicable): Amended Provision – Type Of Effect – Extent* - Commencement Date – Amending Legislation – Amending Provision – Commencement Authority – Savings* - Commencement Order*  ?

          *if applicable

Following previous retained text repeals

Where the amendment in your current Point in Time brings the repeal of the Part, Chapter, Schedule or Act wholly into force and/or extends the repeal's extent to the whole extent of the Part, Chapter, Schedule or Act the instructions in this section should be followed. Note the following instructions are a temporary workaround in the absence of the batch repeal tab on the higher amendments "Update Details" page.

Instructions

  1. In the effects spreadsheet identify:
    1. the part, chapter or schedule to be repealed;
    2. the geographical extent of that repeal; and
    3. it is the final stage of the incremental repeal (the repeal is now wholly in force/whole extent).
  2. On the "HighLevel" tab of the higher amendments "Update Details" page, scroll down the "Table of Contents" to find the Part, Chapter, Schedule or relevant Heading level to be repealed and click on it. This will take you to the familiar lower level style "Update Details" page.
  3. Click the "Check out for edit" button and set up your XMetaL workspace, including opening "Attribute Inspector" link.
  4. In the "Status" section of the "Attribute Inspector" set the provision to "Repealed" at the following levels:
    1. "Part/Chapter/Schedule heading";
    2. "Pblock";
    3. "P1group"; and
    4. "P1".
  5. For each child provision in the "RestrictStartDate" section of "Attribute Inspector", enter your current Point in Time date.
  6. In the first child provision of the Part, Chapter or Schedule replace the "<P1para" content with "<P1para> <ukl:Text>. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .</ukl:Text></P1para>" by:
    1. deleting the "P2" tags and any lower tagging;
    2. inserting the "<ukl:Text></ukl:Text>" tags after the opening "</P1para>" tag; and
    3. inserting the following dotted line into the text tags: . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .
  7. Right click on the opening "<P1para" tag in the first child provision (which has been formatted as instructed in step 6 above) to highlight and copy it.
  8. In the next child provision right click on its opening "<P1para" tag and paste the copied "<P1para" from step 6 above, do this for all other child provisions in the part, chapter or schedule.
  9. Right click on the "<ukl:CommentaryRef Ref>" tag after the "<ukl:Number>" at Part level (this is at the top of the document after the "<ukl:Part" opening tag) to highlight and copy it. In each repealed child provision, paste this F-note after the opening "<ukl:Pnumber>" tag but before the number of the provision.
  10. On the toolbar at the top of the page click "Legislation" --> "Check In".
  11. In the pop-up "Document is checked in successfully" click "OK".
  12. Go back to the "Update Details" page:
    1. refresh the page by pressing "CTRL" and "F5" at the same time,
    2. check the amendment edit status has changed to "Edit Complete".
  13. Select the tab "Newly Edited Version" or the "Preview Provision" button:
    1. check the amendment is formatted correctly: there should be a dotted line at heading level only,
    2. check the annotation is:
      1. in the introduction of the Part, Chapter or Schedule and also in its corresponding sections when checked separately;
      2. is correct with reference to TOES:
        1. it is punctuated correctly, and
        2. the following elements are present (as applicable): Amended Provision – Type Of Effect – Extent* - Commencement Date – Amending Legislation – Amending Provision – Commencement Authority – Savings* - Commencement Order*  ?

            *if applicable

Tips

  • Leave the text of all the headings and cross-headings as you have already set their status to "Repealed" in step 4 above.
  • If you have completed the above steps and the provisions are not formatting correctly upon check in, contact a reviewer who will in turn notify TSO to change the Match attributes.
