Auto Repeal: Wholly In Force and Whole Extent only

These amendments are not carried out in XMetaL but automatically generated by the system when the Auto Repeal button has been selected from the "Update Details" page (accessed by clicking on the "Details" button next to the update task you are going to complete on the "Update Overview" page).

Instructions

  1. In the effects spreadsheet identify:
    1. the Part, Chapter or Schedule to be repealed;
    2. the geographical extent of that repeal; and
    3. if there are any qualifications to the "IF Date".
  2. On the higher amendments "Update Details" page, scroll down the "Table of Contents" to find the Part or relevant heading level to be repealed.
  3. Select the "Auto Repeal" button next to the heading of that Part, Chapter or Schedule.
  4. In the pop-up click "OK", the system will automatically carry out the repeal and refresh the "Update Details" page.
  5. Select the tab "Newly Edited Version" or the "Preview Provision" button:
    1. Check the amendment is formatted correctly and consistently within existing text,
    2. Check the annotation is correct with reference to TOES:
      1. is it punctuated correctly, and
      2. are the following elements present: Amended Provision – Type Of Effect – Extent* - Commencement Date – Amending Legislation – Amending Provision – Commencement Authority – Savings* - Commencement Order*  ?

          *if applicable

Manual Repeal: Limited Extent or In Force For Specified Purposes and Whole Extent

Instructions

  1. In the effects spreadsheet identify:
    1. the Part, Chapter or Schedule to be repealed;
    2. the geographical extent of that repeal; and
    3. if there are any qualifications to the "IF Date".
  2. Scroll down the "Table of Contents" on the higher amendments "Update Details" page to find the Part or relevant heading level to be repealed and click on it.
    1. This will take you to the familiar lower level style "Update Details" page.
  3. Click the "Check out for edit" button and set up your XMetaL workspace.
  1. In the amending provision, identify which words are to be repealed.
  2. In the amended provision, highlight the words to be repealed.
  3. Single click on the task to highlight it in the "Resource Manager" window.
  4. On the toolbar at the top of the page click "Legislation" --> "Textual Amendments" --> "Repeal"; this will:
    1. Generate a green tick next to the task in the "Resource Manager" window,
    2. Insert the annotation of the task, and
    3. Repeal the highlighted wording, bracketed by opening <repeal> and closing <repeal> tags.
  5. Check the annotation has been generated.
  6. Scroll back up to the relevant section and check the correct wording has been repealed.
  7. Delete any unnecessary spaces between the existing punctuation and the repealed tags and words, or insert a space where appropriate.
  8. On the toolbar at the top of the page click "Legislation" --> "Check In".
  9. In the pop-up "Document is checked in successfully" click "OK".
  10. Go back to the "Update Details" page:
    1. Refresh the page by pressing "CTRL" and "F5" at the same time,
    2. Check the amendment edit status has changed to "Edit Complete".
  11. Select the tab "Newly Edited Version" or the "Preview Provision" button:
    1. Check the amendment is formatted correctly and consistently within existing text,
    2. Check the annotation is correct with reference to TOES:
      1. is it punctuated correctly, and
      2. are the following elements present: Amended Provision – Type Of Effect – Extent* - Commencement Date – Amending Legislation – Amending Provision – Commencement Authority – Savings* - Commencement Order*  ?

    *if applicable


    Select the "Auto Repeal" button next to the heading of that Part, Chapter or Schedule.

    1. In the pop-up click "OK", the system will automatically carry out the repeal and refresh the "Update Details" page.
